TERMS OF PAYMENT
Payment is by credit card or direct deposit into our account in advance of delivery, unless previously approved and purchase order number is quoted. All payments are net unless expressly arranged with the approval, in writing, of B Seated Global Pty Ltd. Offical quotes are valid for 30 days from quote date.
Purchase orders placed by any person, or firm or company through its employees, whether in writing or verbally, are deemed to incorporate these terms and conditions.
CUSTOMER CUSTOM ORDERS
Orders accepted by B Seated Global Pty Ltd . for products specially manufactured to Customer specifications or any products modified to Customer specifications require a deposit of 50% of the value of the goods and cannot be cancelled. The balance of outstanding amount is payable prior to goods leaving overseas ports.
CANCELLATION OF ORDERS
Where B Seated Global Pty Ltd . agree at the Customers request to cancel an order prior to delivering the goods to the Customer, B Seated Global Pty Ltd . reserves the right to charge for all costs incurred prior to the cancellation and to charge a cancellation fee of up to 30% of the price of the goods to cover overheads associated with the order. The Customers request must be in writing and prior to the delivery of the goods. Custom orders cannot be cancelled, once the goods have been produced and the customer will be liable for the full price of the goods. If goods are received and do not meet the exact specifications, B Seated Global Pty Ltd has the right to exchange goods only. Cancellation of any order will incur a 30% cancellation fee once payment has been received. Full amount is applicable if cancellation occurs after production has finished. It is the purchasers responsibility to pay the freight cost incurred for return of all goods
Deposits and payments in full will not be refunded and B Seated Global reserves the right to correct any goods delivered that do not meet specifications and requirements.
Extra labour will be charged for at the discretion of B Seated Global Pty Ltd. Unless otherwise stated pricing does not include assembly of goods. There may be surcharges for credit card transactions as applicable . If customers delay receipt of goods or orders there may be storage charges incurred and customers will be liable for any additional storage charges and additional freight charges where applicable charged by third party ware housing.
At the request of the customer samples may be sent by B Seated Global to customers however B Seated Global will endevour to send the exact samples required but in many instances the samples will not match the exact Item as viewed on the web site of B Seated Global as it is impossible for B Seated Global to have every sample available but B Seated Global reserves the right to send samples at clients request in specific instances to show the seat shape where the rest of the shape of the chair will be different to the actual image viewed on the web site or the sample sent may be to view the back where the seat may differ from the image on the web site , B Seated Global cannot be held responsible if the sample does not match the image viewed on the web site the clients cannot hold B seated responsible for receiving a sample then claiming what they received is not the sample sent , this may apply to any of B Seated Global's products.
Unless otherwise expressly stated by B Seated Global Pty Ltd ABN Number 90620400197 & ACN Number 620 400 197 in writing, all goods will be charged at prices ruling on the date the purchase order is accepted and are subject to Goods and Services Tax. Orders do not include freight and freight charges are applicable all goods are quoted FOB our Padstow Warehouse in NSW. If the products arrive and the deposits have been paid and B seated Global has notified the client and the clients does not take delivery on and when payment is due B Seated Global has the right not to refund the deposit and sell the goods after thirty days.
The customer hereby disclaims and right to rescind or cancel the contract or to sue for damages or to claim restitution arising out of any misrepresentation made to him by any servant or agent of the seller and the customer acknowledges that he buys the goods relying solely upon his own skill and judgement and that the seller shall not be bound by nor responsible for any term, condition, representation, or warranty other than the warranty given by the manufacturer which shall be personal to the customer and shall be personal to the customer and shall not be transferable to any subsequent customer. B Seated
Defect/returns / change of mind. The customer shall inspect the goods on delivery and shall within 7 days of delivery notify the seller of any alleged defect , shortage,in quantity , damage or failure to comply with the description or quote . The seller shall afford the seller an opportunity to inspect the goods within a reasonable time following delivery Jurisdiction and state where contracts are concluded The jurisdiction will be under the State of NSW and all contracts are concluded at the trading office of B seated Global which is in Waterloo NSW.
All quotes and pricing have been based on quantities specified on the quote. Changes to quantities will be subject to further negotiation.
B Seated Global Pty Ltd reserves the right to commercially match colours and/or substitute without notice. B Seated Global Pty Ltd . reserve the right to alter the specifications for future orders and can not guarantee to match any previous orders.
DELIVERY LEAD TIME
Delivery lead time quoted is calculated in working days excluding Public Holidays. Delivery lead times stated are from receipt of deposit with accepted written order and are also subject to third party supplier lead times and deliveries. Further to above any delays in Shipping from overseas ports , Australian customs hold on containers for security and screening or quarantine restrictions B Seated Global cannot be held responsible for these delays which are beyond B Seated Global's control . B Seated Global cannot be held responsible for any financial loss to clients which delays are beyond B Seated Global's control.
Delivery includes transportation of the goods to site and additional charges will apply for hand unload. Pay be suspended by B Seated Global Pty Ltd . in the event of any strike, lockout, trade dispute, fire, tempest, breakdown, riot, theft, crime, civil disturbance, war or legislation. The inability of B Seated Global Pty Ltd . to procure goods due to any of the foregoing causes or any other occurrences preventing or retarding performance of the contract of delivery of goods , no responsibility shall be attached to B Seated Global Pty Ltd . for any delay, default, loss or damage due to any of the above causes, or to any cause beyond the control of B Seated Global Pty Ltd.
Unless otherwise specified, the following warranties apply to all B Seated Global products: Two (2) years on all seating products. One (1) year for all veneer or laminate products. Should the goods prove to be defective within this period, and provided that the damage is not due to the use or misuse of the goods or from fair wear and tear, B Seated Global will at its discretion, replace or repair defective goods at our expense. The B Seated Global warranty will only apply to goods being used for their designed purpose, any alteration to this or modification to the product outside of the original purpose will void all warranties. Any of the products warranted that are misused will void all warranties.
Warranty claims must quote invoice number and date of purchase and are subject to approval by B Seated Global Pty Ltd . The Customer is responsible for risk to the goods whilst being returned and the cost of freight for said goods. Where goods are exposed to excessive weather conditions goods need to be either maintained on a regular basis by applying oil in the case of wood products or cover in the case of plastic products B Seated Global cannot be held responsible for any damages resulting from damages.
The warranty does not cover.
- Any failure caused by unreasonable use
- Failure to provide proper care and maintenance
- Normal fading due to light/ sunlight
- Scratching and chipping of paint or timber finishes
- Stain. , discoloring , corrosion and damage caused by contact with chemicals
It is recommended that chairs are stacked to only 4 or 5 depending on the chairs. Do not over stack chairs and do not move chairs by dragging along ground over stacking and dragging of chairs reduces the life of the protective feet on the legs and can reduce the life and / or damage the frame of the chair due to the weight of the stack inherently to stack chairs the individual chairs must touch , so the process of stacking will mark and scratch the chairs, the degree of severity of the marking and scratching depends on the standard of care used during stacking. The warranty does not cover marking and scratching and other wear and tear from stacking any use of the furniture sold for the purpose that it was not designed for will void any warranties.
Do not lift tables by the tops eventually the tops will pull loose from the bases. Pick up tables with the bases and the top together. Tables are not designed to be stood on or sat on this will void any warranties. Often table tops do not come with self tapping screws please make sure your local hardware store supplies these to you put the table top on the floor that has a piece of cardboard or cloth underneath the top to avoid damage the attach the base Tops that are re-drilled by using incorrect screws will damage the tops and voids the warranty. Make sure the screws are not too long that the will come through the top of the table tops.When storing tables make sure they are stacked top to top and not base to top because then tops can get damaged.
Chrome Finished items
Do not leave outside. Wipe chrome items down. Do not use at coastal areas.
Clean with mild detergent rinse and dry throughlycast aluminum components in furniture will oxidize near salt waterplease regularly wipe with soapy water and polish with aluminium polishPlease note that if there is any doubt about cleaning procedures please contact B Seated Global.
Property of the goods shall remain with B Seated Global Pty Ltd . until such time as full payment is received. If payment is not received, or if B Seated Global Pty Ltd . believes that the Customer may fail to pay for the goods when payment is due B Seated Global Pty Ltd. may re-take possession of the goods still in the control of the Customer.
